Mama Bear thanks for weighing in! let me illustrate why you are both empiricaly and otherwise, wrong.
There are large mutual fund complex (s) in America, people invest in a wide range of funds through them, but the interesting thing is; that once money is in the fund, all shares are registered to a Parent ie(affiliate) company, which has the ability to take whatever action they deem with Shares held thereof. This is what enables the Supply demand equation of a stock to totaly be changed. Do some research on low float stocks with 10% to 15% of the shares short. Companies with tremendous prospects, rising sales and cash flow numbers that anyone would envy.

So you mammmm would continue to believe that clap trap about "a signed hypothecation agreement therefore....etc, blah, blah blah"

No hypothecation agreement is signed by the fund holder regarding shorting stocks.

I say that the American public, (those who INVEST Buy and Hold) are being ripped off by people that see wall street as not a place to invest money, but to churn other peoples money through a system of cycles, a few very powerful folks control. Keep your eye on the index, right.Shorts are at an absolute record high right now, everyone seems to be doing it, i guest that sophistry is what the market will begin to deal with soon.

Fundamentals not withstanding, Scarcity or the lack of it, in a supply demand market is a most valuable tool in assessing value, more so than any rationalized index's current momentum. Your ability to be Short a stock you know nothing about, may never be an issue. For you it may always have been a matter of luck.
