Hello NorthPoint supporters - here is a report on information that Ms. E. Lynn Schoenmann, the Federal Attorney who is NorthPoint's Trustee, gave us in a telephone conversation that I had with her today. She knows that this is being reported to our NorthPoint Shareholder's Group.

(1) NorthPoint's lawsuit against Verizon is officially classified as a "Track #1 Case". That means that generally, the Court would like to have it settled or go to trial within one year from the time that the lawsuit was filed. Ms. Schoenmann said that she has been trying to get it to trial by the end of this year, but she can't guarantee that will happen, especially since the Status Conference has now been re-scheduled for October 26th.

(2) The Status Conference and virtually all other Court matters were re-scheduled because of the terrorist attack in New York. None of the delays to date have been caused by Verizon or NorthPoint.

(3) Here is the explanation for the PACER information that Techstar posted here: Canadian Imperial bank tried to get involved in control of the lawsuit, with a Motion dealing with how much control Secured Creditors would have. The ruling is that Ms. Schoenmann retains control. She has to inform the bank and other secured creditors about any settlement offers, but the secured creditors have no say about accepting or rejecting any offer. Canadian Imperial is a $70 million creditor.

(4) There have been no negotiations with Verizon and there have been no settlement offers from Verizon.

(5) Depositions and other preparations for trial are on-going.

(6) Here's a good one: there is a hearing on October 15th for final approval on (a) the terms of the lawsuit financing; and (b) the selection of the party who will actually finance the lawsuit. Angelo & Gordon's offer to provide $7.5 million for 15% of a settlement or 20% of a jury award was only the first offer to finance the lawsuit. There are other parties who are also interested in financing the lawsuit and Ms. Schoenmann is negotiating for the best deal and the best terms for NorthPoint. She said: " I am required to do whatever is necessary to maximize value to the estate".

(7) Here's the best part: Ms. Schoenmann said that it was important that the secured creditors had no control over the case because "The value of this litigation far exceeds the amount of money that NorthPoint owes".

My opinion is that Ms. Schoenmann is determined to do this correctly. She is concerned about everyone who is involved on NorthPoint's side of the table. I believe that we are in very good hands.
