Americans like to indict people, even without substantial evidence. For the sake of the question, lets assume they have subsantial evidence.

I cannot answer that the way you phrased it.

I can say, that we should arrest him by any means that does not involve bombing of buildings, military or otherwise. We can even kill him, but we had better have evidence.

We have to sneak in and grab him. If we kill all of his guards in the process, that is what has to be done. And it is justified in my mind.
