Too bad! States and localities have regulated restaurants from having smoking allowed in public areas. EPA regulates air pollution country wide. And you can be sued or face criminal charges, if you spray a substance that caused severe disability or especially, the death, of another. When it affects others, it can be regulated and/or legislated.

Taking your argument to the extreme, you ask that anyone can do anything with their property including building nuclear, thermonuclear, chemical or biological weapons along with testing on non consenting people. Sorry, you would lose that argument.
