ADVISORY/MoBeta, Inc. Announces Internet SLAPP Trial

LOS ALTOS, Calif.--(BW HealthWire)--Sept. 25, 2001--The nation's first Internet SLAPP trial is scheduled to begin in San Jose, California on October 22, 2001.

The civil trial is expected to last five to eight weeks. The Plaintiffs are Varian Medical Systems, Inc., Varian Semiconductor Equipment Associates, Inc., and two Varian executives, Susan B. Felch and George Zdasiuk. The Defendants are Mary E. Day, President and CEO of MoBeta, Inc., and Cross-Complainant Michelangelo Delfino, Ph.D., a Vice President of MoBeta, Inc.

The Case No. is CV780187. The lawsuit was filed in Santa Clara County California Superior Court on February 26, 1999. Information about this SLAPP and its status in the California Appeals Court, Case No. HO22233, can be found at appellatecases.courtinfo.ca.gov. The Plaintiffs are represented by Orrick, Herrington & Sutcliffe law firm in Menlo Park, California and Gerald Z. Marer, Esq. of Palo Alto, California. Ms. Day is represented by Randall M. Widmann, Esq. and Dr. Delfino is represented by Glynn P. Falcon, Esq. Both are Palo Alto, California attorneys.

MoBeta, Inc. is a near three year old R&D company with patent protected medical device technology. It is not a named party to the lawsuit.

I found this while reading the Applied materials board.
This site is totally biased against the Day/Delfino defendants, even though they claim to be impartial. I do not know enough about the case & really don't have the time to do more research.
