I think your instincts are correct. It is a sad fact, but true, that during war time civil liberties have been given short shrift in our nation, among many others. See, e.g., "All the Laws but One : Civil Liberties in Wartime" by William Rehnquist, about habeas corpus during the Civil War.

In a democracy, we must always be cognizant of the fact that democracy is inconvenient to autocrats, plutocrats, oligarchs, and countless others who find the so-called "mob" (that's US) inconvenient.
