I agree that Osama Bin Laden is a bad guy and should be taken out, I agree that the terrorist actions are horrible and should be stopped. But there is more going on here. There are legal and emotional consequences to the concept of war. We as a people are being asked to pay the price for a war, not just a monetary price.
For example: Members of this administration are demanding that we drill for oil in the Arctic refuge because we are at war! (Forget that oil is getting cheaper than it has been for years) Any polititian who questions whether this is a good idea is accused of being a traitor and threatened with a thousand flag waving zeolots in his home district. This is a real price we pay for using the concept of war.

Are we really at war? What nation are we at war with? Is it valid for insurance companies not to pay claims since we are at war? Is habius corpus in effect? Does any other country in the world accept that we are in a state of war?

What we have is a large scale determined international criminal probe going on. It's an important endeavour but it is not a war.
