The solution is quite simple, really-- make it possible for the winning party to recover its legal fees after winning the case if the judge/jury determines the litigation to be without merit.

Sure there's a way.

Problems: Milberg Weiss' bread and butter is this kind of lawsuit. They'll fight tooth and nail if someone tries this. That means any such action could get very expensive. Even then, winning a frivolous lawsuit judgement isn't all that common, so a company would be rolling the dice to take this approach. If Intel is looking out for its shareholder interest, they shouldn't be rolling the dice.

The interesting thing here is that a piece of this lawsuit is indeed personal in this situation, which would make Intel less willing to settle.
