The decision not to release some DOD spectrum should be good for service providers using CDMA, compared to those who need more spectrum for GSM or TDMA. Would the higher frequency bands that are going to be made available for 3G increase the cost for service providers over the cost of the existing bands? It seems to me that if a GSM service provider had to rely on two different frequency bands in order to support 3G, this would not be very competitive with CDMA service providers and handset users with phones that may already support 3G services.
