2.11 Prohibition on Assassination. No person employed by or acting on behalf of the United States Government shall engage in, or conspire to engage in, assassination.

IMO Bush and team were thinking about this prohibition right from the outset and that, as much as other reasons, is why they called this a war from the outset.

Killing your enemy during wartime is not assassination.
