OK Folks, I was a former EHS (SHE) Manager at Mobil Corporation in west Texas/Rockies back in 1998-1999. I could use your help.

ExxonMobil denied giving me a severance package under the Mobil Corporation Severance Plan back in early 2000 and in turn, I filed suit pro se in late 2000 against ExxonMobil over the matter in the Federal District Court of Texas, Western District. The Federal District Court in Texas just issued a 22-page decision on my initial Motion for Partial Summary Judgment.

In that decision the Court denied my Motion for Partial Summary Judgment; however the Court held that I had made out a prima facie case that ExxonMobil had improperly tried to alter the terms of the Mobil Corporation ERISA Plan and that I had also raised a genuine issue for trial as to whether Mobil Plan contained a proper Benefits Claims Procedure as required under the federal ERISA law, or indeed contained any Benefits Claims Procedure at all.

The results of this case may affect all former employees of either Exxon or Mobil from the December 1, 1999 merger date forward if you did not receive your full benefits package and left the Company at any time from the 1999 issuance date of the sevrracne plans up to the current date.

I am in the investigative phase of the case and could use your input on two points:

(1) Original Mobil Corporation Employee Selection Process. Can you tell me of any former Mobil employee that was also denied either part or all of a severance package under the Mobil Plan back in the 1999-2000 original selection process? What parts of the severance package were granted/denied? Can you give me some contact information for that person? Email, address or phone number?

(2) Exxon or Mobil Post Merger Employees Who Left ExxonMobil after 1998. Now this is for ALL either Exxon or Mobil employees who accepted a job back in 1999-2000 merger selection process but who have since quit ExxonMobil right up to the current date.

Did this person ask for or get offered all or part of a severance package under either the Exxon or Mobil ERISA Plans? Or offered other additional severance benefits not listed in the Exxon or Mobil Plans? What was ExxonMobil's answer?

Finally did ExxonMobil ask this employee to sign a confidentiality agreement to remain quiet and not let other employees or people know about any such post-merger settlement under either the Exxon or Mobil ERISA Plans?

Your input would be greatly appreciated, and I'd be glad to share with you the current status of the case at any time, a copy of the current decision, and of course the ultimate results of my solo dispute with ExxonMobil....

Sincerely,

Doug Fant
