I don't know if I can splain any better but I'll try. Under our laws, suspects have the right to remain silent. We can't torture people to confess. We can offer them deals to encourage them to confess. We can try to trick them into confessing. But we can't lay a hand on them. It's up to the prosecution to prove them guilty. I'm not questioning that. I don't think the article I posted questioned that. I don't think that any posters have necessarily questioned that. The questioned raised by the article was of material witnesses who apparently cannot be induced or tricked into giving us information about plans for future attacks. Can we go further in those cases? And if we can, how far and under which circumstances? What about if there's a kidnap victim that is buried with enough life support for only a few hours? Do we just sit back and wait for the victim to die when a material witness lawyers up? Well, we have leverage against that witness, a charge of conspiracy or aiding and abetting or whatever. But what if the material witnesses are terrorists who won't talk voluntarily about plans for future WTC-type attacks under any circumstances because they want to be martyrs so we have no leverage? Maybe these material witnesses, given their religious background, are unaccustomed to alcohol and we could get their tongues loose with a few beers. Legally, we can't do that. Should we be able to? What about other drugs? What about their nuts in a vice?
