Opponents of Eugene Scalia's nomination as Labor Department solicitor claim Democrats may have enough votes to filibuster, if they choose. "There's now a very decent chance the Democrats are going to fight over this," says Jon Hiatt, the AFL-CIO's general counsel. A spokesman for Sen. Edward Kennedy (D., Mass.) says the senator has asked the Bush administration to reconsider the nomination.

Mr. Scalia, a management attorney and son of Supreme Court Justice Antonin Scalia, opposed an ergonomics standard generated during the Clinton administration. A White House spokeswoman, citing his qualifications and approval by a Senate committee, says "we would hope that the Senate will come together to act quickly to confirm Eugene Scalia."
