But did you read what the Appeals Court said about predatory pricing? They indicated that Microsoft was indeed guilty of that abuse, but couldn't be punished because the DoJ had neglected to charge them with that.

Yes, I read it, and no they did not state that Microsoft was guilty of predatory pricing. There's lots of equivocating language about "maybe yes, maybe no." You're right though, they weren't charged with it.
