You are probably right about people cracking the code on XP so you don't have to activate.

It will still be a big headache for the criminals.

When they counterfeit a copy of Win9x nobody knows the difference and you can sell them in any store. With XP everybody will know they have a counterfit copy and honest people might call the cops which exposes the criminals to a lot more chance of being caught. I think the sceme will help a lot but those that really want to dodge the law will be able to buy a copy for next to nothing.
