Pivotal Court Ruling Bolsters Akamai's Position in Content Delivery Patent Dispute
Trial Set for November 19th

CAMBRIDGE, Mass.--(BUSINESS WIRE)--Nov. 9, 2001--Akamai Technologies, Inc. (NASDAQ: AKAM - news), the leading provider of outsourced e-business infrastructure services and software, today announced that the Federal District Court in Boston has issued an important ruling interpreting the Internet content delivery services patents in dispute in an impending trial against Digital Island, Inc., a subsidiary of Cable and Wireless plc. Akamai is claiming that Digital Island is infringing two Akamai patents, and Akamai is asking the Court to permanently enjoin Digital Island from offering its content delivery services.

``We believe the Court's ruling will allow us to demonstrate that all versions of Digital Island's competing content delivery services are within the scope of the patents that protect Akamai's intellectual property,'' said Kathryn Meyer, Akamai's General Counsel. ``In effect, the ruling undermines Digital Island's argument that Digital Island invented the innovations covered by Akamai's patents.''

The ruling also interpreted a Digital Island patent that will be heard during the trial. ``Based upon the Court's ruling,'' Meyer said, ``we are confident a jury will find that we do not infringe Digital Island's patent or that the patent is invalid.''

Gang, I like EASY and VNCI for this week. VNCI has earnings and should post their second straight quarterly profit with 400%+ revenue growth.

With their military contracts in place, I think this one has a lot of juice ahead of it.
