what do you think would happen if apple lisenced their os to other box makers and spent their resources on developing new internet related devices. do you think that they could gain any significant marketshare against msft.

That's a neat sidestep of the issue, but just because a captive copy of Linux might have been at the core of MacOS Apple would still be branding it as MacOS and would not be distributing their software to the general Linux community which is overwhelmingly running on INTC hardware.

While it is possible to have Linux-based applications which avoid the GPL I'd be very suspicious of claims that one could base an OS on Linux without entanglement. I'm sure Apple's lawyers wouldn't be very enthusiastic about trying this.
