Lincoln did suspend habeas corpus during the Civil War. I'm not sure he did it with the eagerness Ashcroft has, though.

There has usually been some sort of precedence [or legal phrasing] that gets you to If you want to interpret it that way. In most cases the precedence usually turns to examples of the Civil War, as you point out or WWII, or something along those lines. The Terrorism War, if you will, doesn't seem to quite fit.

When I think John Ashcroft, I think of a modern day J. Edgar Hoover. Not as nice a guy as J. Edgar was, but we have more light on Ashcroft than we did Hoover.

Here we have another initiative that has precedence.
