Interesting - the order would apply to persons already detained here in the United States, as well as to those who may be detained outside the US in future. Any person, not a US citizen, who is either a member of Al Qaida, or has engaged in, aided or abetted, or conspired to commit acts of international terrorism, or has knowingly harbored such persons is subject to the order.

I assume that's why Ashcroft has delayed formally charging many of the detainees in custody. The justice department was working on this order, so they did not want to get these guys into the regular US justice system.
