Sun's lawsuit against Microsoft ended a while back. M$FT paid Sun $20million and was enjoined from using the Java logo. They decided not to use Java at all in their boxes. End of story.

You are mistaken if you think somehow that Sun is "distracted" from their business plan. The only thing Scott is "obsessed" about is selling boatloads of Sun hardware, software, and services.

The marketplace for computer hardware, software and services is NOT a zero-sum game. M$FT is not threatening Sun. Both have vast markets that rarely intersect. This has been the case historically, and it really hasn't changed, despite all the noise from the industry press and a variety of "industry analysts".

Both companies should do quite well in the future. Now, if you're talking about HP, that's an entirely different story....
