Hi alanballow; Re declaration(s) of war, history of US. See #reply-16342624 for a link to a pretty complete description of the US history of it.

It turns out that declarations of war are rather rare in our country's history, compared to combat. There's no requirement that anybody declare war. Even though, in this case, the NGO previously declared war against us.

how come we don't have a declaration of war?

Because we are dealing with non-state actors who perpetrated these attacks on the US, congress passed an "authorization to use force", which has nearly the same legal ramifications as a declaration of war (which is normally made against a state).
