A statute or order is tested for constitutionality as it is construed and applied. It will make a great difference whether the order is only used to try war criminals in a foreign country or is used to try citizens in the U.S.

Nifty Washington Post article.

washingtonpost.com

There's two areas that I would added to the article. Small item...in establishing and accepting Executive authority, the view should be what potential exists for future Administrations.

Second item. IMO, the Administration has also shown a tendency towards grabbing "authority" from the people as well. One example, Ashcroft's exercise of Federal Authority over the voters of Oregon.

I thought the term Imperial Presidency was a pretty on-target label.

One fun thought I had was that the use of War Powers against al Qaeda members isn't quite the same as the frequently cited precedences of WWII, Civil War, etc. In those citings there was a true "War" in the sense that there was a nation State that we actually could declare war on. Al Qaeda is a bit different, they aren't a nation State, their more akin to organized crime. My wife asserts we should be looking at the war against the Barbary Pirates [that point caught me unprepared].

The US most certainly has lost far many more lives in the War on Drugs than it has in the War on Terrorism; drug cartels and organized crime have a military component about them. Why not use the same sort of War Powers authority in the War on Drugs?
