why cannot the fetus be protected under self defense.


I'm not sure you have a good self defense case when you kill some one who is trying to kill you in self defense.

If I shoot at you and miss, and you shoot back and miss, and then I shoot back and kill you, is it justified self defense because you where trying to kill me? Of course the difference in this situation is that I would have been deliberately trying to hurt or kill you while a fetus is not deliberately trying to kill the mother, but would you say that self defense can not apply when the other person is in the process of causing your death if this process is not actually intentional?
