i must disagree. cherry picking, or data mining, occurs when one cites some isolated fact as proof of a broader observation or trend. the mere mentioning of the fact is not data mining; the crime occurs when one tries to draw larger conclusions from it.

Crime? Relax, Mucho. Otherwise you sound like the old DataSnooper over at the Fool.

Since you won't allow us to "cherry pick" things like studying the share price appreciation of MSFT, CSCO, ORCL or INTC (or any other inside jacket cover material due to a marketing decision) when they went public because you don't like those types of cherry picking crimes - are we to believe your thoughts that the NAREIT long/Nasdaq short pairing was the "greatest index pair trade of all time"? Would that be available to be used as inside jacket cover material? How about if we get Malkiel to change his tune and just say "Forget random walk theory, just buy the great companies at their IPO in dynamic industries."? ;-)

The "greatest" of all time? Perhaps you have the data to back it up that out of all the index pair trades in the history of the markets - it was the "greatest". What is the Nasdaq down % wise and the NAREIT up since that "greatest index pair trade of all time"?

For that matter, one could have purchased some cherries off the September lows and held them the past 9 weeks and beaten that "greatest pair trade of all time" on a percentage basis. Does that make such a trade "greater" than another trade? Inside jacket cover material for a swing trading book? And don't tell me that is not fair, because using forward revised earnings estimates - there were some cherries ripe for picking on a forward multiple basis during those September lows and people were buying them off of the panic reaction to the terrorist attacks. Maybe those that dipped to forward multiples in the teens will not live up to their forward estimated earnings due to a possible need for further estimate revisions, but as the revised estimates stood in September some attractive entry points were presented for many companies for those interested in stepping up to the valuation table or trading table.

i sense you'd like to use the cherry picking term, but please wait til i provide a better entry point, which i'll try to do in the near future. then i will reward you with a well-deserved "touche!" acknowledgment.

My grandfather had a cherry orchard and the term cherry picking has only one meaning in my family. Ditto for the woodshed...
