The speculative nature of the trades, the duration of the hold, and the frequency of trade may come in to play in extreme cases, but for the ordinary private citizen who dabbles in the stock market while holding down a day job, or in his retirement, the auditors seemed to think the life time capital gains election would hold.

Perhaps that's true. It does come down to how the auditors want to interpret the rules (or lack thereof). I wish that clause applied to US stocks as well. I trade so few Canadian stocks, I'm not really helped by that election. Anyway, it's not the Arcorp case that has me worried, it's YOURS. <g>
