But the key matter brought up on CNBC is there had been a law(called irisca--or something) that would not allow any 401k plan to have holdings of more than 10% stock in any company(including it's own).
The feeling of the guest is this rule must be re-asserted as overweightedness in the company one works in is getting out of hand.
As for the free choice the glaring problem is at least 90% of the public simply don't know enough about the market place to make "free" choices.( i can't even talk the market anymore with nearly anyone i know as they have no idea what i am talking about and that includes a medical doctor and a biochemist:)
I loved that survey that asked real investors 10 basic questions on the market and 80% got only one or 2 right!! Something like 90% did not know that margin had risk! Max

Also, don't forget that 401Ks are often rolled into an IRA when an employee changes jobs.
