I'm not quite sure that judicial precedent applies in this case. I'll assume that you're referring to judicial precedent during WWII [maybe you're talking about something else]. There was an official, i.e., legal, state of war; here there is not.

The reasons I've seen are bogus. The Civil Court system has handled classified/intelligence information, protection of the Court, and protection of juries in drug related cases.
