The fact is these military tribunals are authorized by law, there has been judicial precedent upholding their use, I'm not quite sure that judicial precedent applies in this case. I'll assume that you're referring to judicial precedent during WWII [maybe you're talking about something else]. There was an official, i.e., legal, state of war; here there is not. there are good substantive reasons for using them in these circumstances The reasons I've seen are bogus. The Civil Court system has handled classified/intelligence information, protection of the Court, and protection of juries in drug related cases. jttmab
