I have to differ with you here. Maybe you don't need that formal declaration from Congress to recognize a state of war, but I would think a court would require that to recognize such a legal fact.

And Bush keeps saying we are at war. When was that declaration? And against whom? Must a declaration of war be against a state? Could not the US declare war on the Taliban and al-Qaeda?

And WHEN did a PRESIDENT on his own, without Congress, get the power to declare war? Precisely which Article of the Constitution allows this?

Remember, JLA, there are good reasons that limits are placed on Presidential power in the Constitution. Very good reasons. A President is a President, not a god.

As to those trials in WWII: there was an official, legal state of war then. Things can be done during wartime that are not legal in peacetime.

Remember Jane Fonda and her little visit to N. Vietnam during the Vietnam War? The reason she was not tried for treason ("giving aid and comfort to the enemy") was that legally there was no enemy because legally there was no war. I have long considered this to be one of the prices the government must pay for attempting to circumvent the Constitution.
