Aus, not only does Lexar look ridiculous, it may risk sanctions under Federal Rule #11 for filing a frivolous suit. Lexar has followed a policy claiming it always was the first with the best in flash memory intellectual property. Pretek has a good case if it can show that its earlier patents are at the heart of its products. But if Pretek also used art that was part of Lexar's IP, then either Lexar has invalid patents (because of earlier art) or Pretek could still be held accountable to the extent that is also used Lexar IP.

At the rate these guys are going with their litigation, they'll use all their cash flow for legal fees, leaving major advances in flash technology to stronger companies, like SNDK and Toshiba.
