And I was focusing on the actual time and action of that breach.

Oct. 2, 2001 is within the contract period. Registering ATTBI.COM allowed access to that sight. Whether T decided to post information or not on that sight is not the question. The question is, did they start to build out a system within the contract period? Was it accessable?

I say, Yes! No doubt about it!

I wonder if the lawyers will argue that until they solicit customers and literally plug the wire into the cable plant, that there is no provisioning.

EDIT: Provisioning - "Setting up a telecommunications service for a particular customer. Common carriers provision circuits by programming their computers to switch customer lines into the appropriate networks."
