Certain conservatives are like fundamentalists. They think that the whole constitutional tradition is found in the text itself, rather than needing the broader tradition of Supreme Court cases, legislative enactments, Common Law traditions, executive determinations, and so forth, that have fleshed it out. In fact, the right of the president to use military force without a formal declaration of war has been conceded practically since the beginning.

This is from USC Title 50 Section 2204
(2) the term ''enemy'' means any country, government, group, or
person that has been engaged in hostilities, whether or not
lawfully authorized, with the United States;

And that is sufficient to classify the Taliban and al-Qaeda as enemies. And that effectively means Bush can authorize the government to assume war powers, including military tribunals.

I stand corrected on this.

However, as I remember, there is no time limit on the increased power of the gov't to snoop on the internet. Why should it be treated differently than mail or a phone call.
