I'd say try him in the tribunal. He was a soldier in an enemy force and has given up his rights as far as the US should be concerned.

Jeff,

IMO, when he became a combatant against American forces in Afghanistan, he forfeited his USA citizenship. He "should" be tried as a foreign national who fought against American troops, and should be tried as such. The best solution is that he disappear from the face of the Earth, never to be found again.
