My choice would still be to leave this man in the hands of the NA with all the other prisoners.

The legal issue is what congress's role is in formal declarations of war. The President has declared war on al-Qaeda and the Taliban, just as JFK did on the North Vietnamese. Both satisfy the constitutional requirements of war without formal declarations by congress.

The Rosenburgs were spies, not traitors in an active military conflict.
