Meanwhile, a company that participated in the 1996 C block auction has asked
congressional leaders to closely scrutinize the settlement. “The dominant
characteristic of the NextWave settlement is the parties’ desire for extraordinary
speed in approving the settlement, while shielding it from public scrutiny and
preventing review by an independent body,” Eldorado Communications LLC said in
letters to the chairmen and ranking members of the House and Senate Commerce
and Judiciary committees and relevant subcommittees of those panels. “We urge you
to reject this attempt to dictate to the Congress and to shield the settlement from
rigorous scrutiny by your committees.”

The company complained that if the draft legislation is approved, “there will be no
meaningful court review,” because the measure would streamline any legal challenges
to the accord. The letter was signed by Will Yandell, Eldorado’s chief executive
officer, and Stephen Roberts, its managing director.

Eldorado won three licenses in the C block auction but said it was later forced to
return them because NextWave had pushed the prices for the spectrum too high.
Company officials had said they might challenge the settlement in court.
