Iowa's Miller said the states haven't discussed their proposed remedy with the Justice Department or Microsoft. While the states are still open to negotiating a better settlement, their energies are now focused on winning approval of their remedy in court.

"I don't think Microsoft will come and sign this afternoon," Miller said. "This is an approach Microsoft will resist."

Even the attorneys general aren't clear how the next few months will play out as Judge Kollar-Kotelly proceeds on twin tracks. One leads to settlement, the other to litigation.

Miller said the nine states are unlikely to be involved in the public interest review of the settlement, called a "Tunney Act" proceeding. And the Justice Department is unlikely to be involved in the states' litigation.

But California Attorney General Bill Lockyer, whose state is shouldering a large share of the costs of continued litigation, said the remedy represents "what we would say in Tunney, as well as what the appropriate remedy would be."

Microsoft must file a response with the court by Wednesday.

Big whoop. Within 10 minutes of being online with my new Windows XP a window popped up and told me that I needed to download a file to view the particular page I was requesting (a Java applet or something). I said OK and within 30 seconds it was done and installed.

They gotta make a civil suit out of that?
