Generally, when one is critical of something, it means that one possibly has an alternative action in mind...

I know that's logically the case but it's been my experience that one doesn't need a specific alternative to be critical.

However, having said that, I do have thoughts. As I recall, your question originated in a discussion about the military tribunals. My views are (a) the admin should not use them for the detainees (wasn't there a marvelous old Pete Seegar song about "detainees"?) jailed in this country; (b) should not change the rules about bugging lawyer client conversations which I've been led to believe already permitted that with a judge's permission; (c) should drop the 2/3rds voting rule for conviction; (d) should create, most important, all rules via vigorous cooperation with congress (we need a unity govt in these times); and (d) I'll think of some others if you ask. Whoops, there is one I left off and that is they should make whatever tribunals are used a model for the application of justice, not a model for revenge-security. It strikes me that in their balancing act they've gone too far to the latter side.

The biggest problem though is a personnel one. The Bushies were stuck with Ashcroft after the religious right came to George's rescue in the South Carolina primary. Somewhere in that morass, Ralph Reed exacted a promise of veto rights over the AG position. So that when Ashcroft failed in his Senate relection bid, I think Reed and his crew mobilized. Or so I believe. Therein lies the mistake.
