Our difference is in the severity of the criticism. I have seen criticism that has been much more than "fairly light, cautious, and restrained". If it were that light I would have no problem at all and Ashcroft probably would have responded in a more restrained way. I agree that "aiding terrorists" is strong, but so are SOME of the charges that were made BEFORE he made that statement. I am a big fan of responding back in kind.

I agree. But again there has been much that is not "open and civil". You have stated that people are "trashing" the constitution. I view that as a bold claim, and you seem to view it as "open and civil debate".

On principal me and you seem to view the issue the same. Our differences are squarely set on the degree, which we obviously view differently. But its been fun chatting.
