On December 11, 2001, the Company filed a complaint in the Circuit Court for Palm Beach County, Florida, against an unidentified defendant known as "Spadeboy" who posted false defamatory, and libelous information about the Company on the internet website known as Raging Bull. The Company's Complaint seeks to ascertain the true identity of the defendant known as "Spadeboy". Once the true identity of the defendant is discovered, the Company will pursue all available remedies.

Six Posts on Message Boards Results In Company Lawsuit
Houston, TX -- (OTCBB NEWS NETWORK) -- December 12, 2001, Eagle Building Technologies, Inc. (EGBT: 8.55) joins the list of companies looking to stop the perceived bashing of their companies on the message boards.
EGBT is looking for "Spadeboy", who they say posted, "false, defamatory, and libelous information about the Company" on Raging Bull.
Eagle is acting fast on the issue, Spadeboy only started posting 6 days ago. Spadeboy posted 9 posts that day and stopped. As matter of fact, Spadeboy was warned by one of the board gurus on only his third post that someone may be looking to sue over his/her comments.
Obviously, Spadeboy has ruffled feathers. The company filed a complaint in the Circuit Court for Palm Beach County, Florida. The complaint seeks to ascertain the true identity of Spadeboy. "Once the true identity of the defendant is discovered the company will pursue all available remedies," according to report filed with the SEC today.
At 1:40 EST, EGBT is off .75 (8%). 143,900 shares have exchanged hands.

That is disgusting. Few words of advise though. Being that I have already stated my feelings about this company what you said was pretty damn stupid. Opinions and statements are 2 very different animals. If he does try and sue you make sure you get all the names in this forum and record the statements during your discovery, especially the statements about brokers working on this board and price predictions. Its in your favor. Also due research into SLAPP and anti-SLAPP lawsuits.

I myself have been trying to get answers to a few questions here, and would appreciate your help as there is much innuendo on this board, and your expert answer will no doubt clear up any confusion that may exist.
1. Regarding the Salinas project, how much of the 340M in revenues will be added to EGBT's top line? and how much will be added to your bottom line as a result?
2. Do you have other projects planned?
3. Are your U.S. manufacturing facilities in Boca Raton, Florida?
4. Please clarify the Kashoggi equity investment that was announced in 1999.
5. Could you please provide a biography for Paul-Emile Desrosiers, the new CEO and President announced on 10/9/2001. He sounds like a good man for the job given EGBT's apparent intention to become a worldwide concern. I might have missed it, but I do not see his biography on your website.

you say it goes higher, I say it breaks down. I have backed my posts with facts, not some fiction as another poster had done. Again, I disagree with spadeboy. I have interesting points that have not been adressed. Everyone here is giving ridiculous price predictions. They dont have earnings. Having 1 qtr hardly qualifies them as being even a 10 dollar stock. There is no PE...therefore...no earnings. AMEX listing, seems someone has either inside information or its a pipe dream. Reverse splits, stock payments in lieu of cash, dilution, the players involved, past companies, missleading press releases...the list is endless. It doesnt matter what my position is. If I wanted to buy the stock I would do the same research on the company as I do with any other company. It wasn't a warm reception when I showed up. Everyone assumed I was short and the insults that were flying hurt my feelings. If I wanted to disclose my position I would. Either I am long, short, or no position. You be the judge.

Just because I dont share the same euphoric view as you dosent mean I am obsessed. I have presented factual evidence. As far as I am concerned, and I have seen it many times, the company *might* be worth $4.00. I feel over the coming weeks we will see what the investors *really* think it is worth. ....is David Blech.
During the early '90's, the erstwhile Mr. Blech ran a small brokerage firm that billed itself as a bio-tech "boutique". Typically, he would charge the obligatory fees for raising money for these small enterprises while lining his own pockets with cheap stock and warrants (typically at pennies, per share). It was a great gig while it lasted but his "greed gland" got a bit bigger than his estimable ego. He wound up spreading himself too thin(kinda like Hitler). The NASD found him to be deficient in his net-cap and in spite of his running around, trying to leverage a bunch of B*** SH** paper-ultimately got the boot.
Since then, I suppose he occupies himself by trading his own account. On the side-he is an elitist bigot that seems to have a problem with folks of the....um, goyem persuasion which basically means that he's p*ss*d off at more than 95% of the world. Since he began contributing to this thread we have since learned:
1) he can't spell (goi?) 2) he can't read, accurately (company filings) 3) he can't produce a reasonable argument ( he continues to submit that a Company that will do better than a buck in earnings has no value) 4) he can't dial a telephone(561-487-3600, ask for D'Amato)
In the meantime, many of his Companies have diappeared or have, at least become seriously diminished. It was very difficult for these neophyte offerings to withstand the onslaught of selling that occurred when Mr. Blech emptied his coffers, once full of founder's stock and cheap cheap underwriter warrants.
Suffice it to say that Mr. Blech took his CLIENT'S MONEY and HIS EXPERIENCE and turned it into HIS MONEY and his CLIENT'S EXPERIENCE!
In the meantime, it is apparent that he lacks polish and poise. I frankly can't understand how someone-with the opportunity to obtain so much knowledge about his industry -ultimately has absolutely nothing to show for it. It must be so frustrating to be one of the fallen-and yet, not have a clue how to get back into the game. Maybe it's a lack of intestinal fortitude or some other personal deficiency. Maybe it's just a complete lack of ethics. Undergirding and overarching everything, I guess it's just another human tragedy!
But, Hey!....on a lighter note-there's no dearth of Eagle Buyers! Saw Goldman in there this week as well as a few institutions. I guess they recognize the entrepreneurial spirit and hard work that has become so apparent to so many!
....and whoever said Institutions don't buy stocks like this are completely wet!

2. I may get to Florida this winter and wonder if Eagle has offices or a manufacturing facility worth visiting?
3. Could you point out in which SEC filing the Kashoggi investment was discussed? I can't seem to find it.

1) No, he's not... which, as far as securities go, is kinda fortunate when taken in light of Senator D'Amato's preferential treatment by the notorious Stratton Oakmont.
Hint: Anthony's "connections" are solid and hard earned. He's respected by the Democrats because of the strength of his relationship with Meyer Berman, a staunch Democrat. His ties to the Republican Party are at the highest levels having worked very hard on Dubya's election campaign.
2) I'm sure that I can arrange a meeting at the offices, but, again it's either Missouri, Utah, or Italy if you want to get dirt under your nails.

So, as I see it (no, I'm not spadeboy); corporate insiders post here and were offended by spadeboy's opinions. So upset, they ran straight to the lawyers.
Hmmm...perhaps spadeboy is him/herself a corporate insider. Do you have a cat fight on your hands?
I checked his posts....seems pretty ordinary to me. Lies? Maybe...so what. Nothing unusual here. Another sanity check is to ask Raging Bull if spadeboys posts violated the stated Terms-of-Service "Rules of the Road"? Not that I see.
Of course, many employ lawyers and filings just as a scare tactic. But I believe using the courts to shut people up won't work without a clear indication of fraud and profit making by the party committing such "acts".
Anyone can file a lawsuit in America. Only the ones who have a case, resources, and the will to go all the way may win. If I were a shareholder in this company, I might be a little concerned that the corporation is going nuts over 9 postings on a message board. I mean is this how my invested dollars are being spent? Being given to some lawyer? There are thousands of potential "spadeboys" out there. Can't keep them all quiet all the time.
I leave the rest alone.

I heard about spadeboy and, after looking thru the message board, don't see anything that refutes what he said. The CEO's panicked response, people lookin for facts, not knowing what they're invested in, critics being severely bashed, rumors and only rumors of future success, and the stock price going downhill. I wish I could sell this short, but I guess it's not possible with an OTC BB stock, which is what this will always be.
