Are you seriously equating the danger of yelling fire in a theatre to saying "Merry Christmas" around Christmas time??

res- Yep, he is not stifling free speech any more than not allowing yelling fire in a theater.

The reason the one cannot yell "fire" in a crowded theater is the imminence of irreparable harm, not the possibility of wounding someone's feelings. The possibility of offense was never considered a compelling state interest overriding free speech, and if it ever becomes so, we will live in a police state, afraid to say what we think in public......
