As Duke pointed out "passive means passive"....creating an agenda from foundation shares means active.

Duke didn't say anything of the kind (is this another "everyone's going to resign from the board, and all the executives are going to leave" type of statement from you?). In fact, his only response, as far as I can see, to my question was "good point", which I assume means that placing your votes based on your share ownership s is possibly okay for a foundation.

Did you buy some CPQ shares based on the arbitrage opportunity? As far as I've seen, CPQ has said it will do just fine without the merger, so what's the big deal?
