The mere thought of this becoming a court of law question scares the crap right out of me. I hope he just goes away with nobody except a couple of special forces dudes knowing where he is.

Exactly. This is not a civil action in a court of law. We are at war with these people. If our special ops soldiers encounter bin Laden's men armed in the middle of the night, what would Dershowitz have them do? Read them their Miranda rights, offer them one free phone call and the services of an attorney at U.S. taxpayers' expense? No. Shoot to kill.
