The decision to abandon the Manassas plant should have an impact on the agreement that established the FlashVision joint venture between Toshiba and SanDisk. If this was done at Toshiba's initiative (to sell excess capacity to Micron), then it should be Toshiba's obligation to make things right for SanDisk. That is, Toshiba should guarantee that production costs in Japan will be at least as low as would have been expected in Virginia. If not, then SanDisk should receive appropriate compensation.

But who can guarantee that SanDisk would pursue its rights, or for that matter, would have constructed the original agreement to assure appropriate compensation if one party decided to pull out? So far, the only thing I can conclude is that SNDK got the short end of the stick.
