It's wrong from first principals of the Declaration of Independance. The government derives it's power from the concent of the governed. That does not include one appointed official appointing another branch of government who in turn can appoint the first to higher office or appoint his friends and relatives. If there was any group who should have excluded themselves from deliberation in the election it was federal judges and the Supreme Court in particular.

As for legal arguments need to check with a lawyer.
