Maurice:

As with other property transfers in exchange for money, the courts have found that NextWave owns the rights to use the spectrum and the government as a creditor can't just grab the property they supplied, which would damage other creditors.

You continue to amaze me Maurice. First of all, the court(s) did not confirm Nextwave's claims. Actually a number of court(S) confirmed the Govt. claims. Only one court affirmed Nextwave's claim. Second, There is NO PROPERTY involved here.. It is a license! A use license, IF all the terms of the grant of the license are met.

You know LICENSES.. Like those things that Qualcomm sell. Do you believe that if LU and MOT filed for Bankruptcy, that a court should allow MOT and LU to continue to use QCOM IPR to manufacture equipment and make money off of QCOM IPR even though the BK judge said that the LICENSE that QCOM sold them were now the property of LU or MOT. and that LU and MOT were free to use QCOM's license without paying a royalty?

Licenses have "Terms of Use". And Nextwave has violated one "terms of use" after another.

Senator Hollings has shown that our govt is not completely coruput. And has not allowed a group of "borderline criminals" to just walk away with the Property of the United States of America, without a fight.

Hip, Hip, Hooray!!! For Senator Hollings!

Senator Hollings blows the chance of getting many $$billions for the US government by ruining a perfectly sensible agreement the FCC and NextWave and the latest bidders had come to.

From 23 Dec 2001:

<It's going to be funny when the Supreme Court confirms that the USA Senators and government can't just steal property from people. Power is a weird, brain contaminating thing and it seems that the senators are blinded by being big and tough and greedy. They want to get their greedy paws on NextWave's and the creditors' money.

The government did zero to create the value in that spectrum. Allen Salmasi and creditor QUALCOMM were directly instrumental in creating that value by inventing and making CDMA a viable technology. Because he understood the technology, he had the confidence to bid more than anyone else for the spectrum.

If Senator Hollings and others in their ignorance refuse the agreement, they will probably see their chance to get some of the money slip through their grasping fingers.

I should be a legal consultant - would have saved US taxpayers about $10 billion, give or take a bit.
