Actually, Justice Tony is right on the mark. He was disgusted by the lack of discipline in the Supreme Court's review of equal protection issues. He is analytical and frank--even if I disagree with most of what he produces. Anytime a brother justice says, "We have no established criterion for 'intermediate scrutiny' either, but essentially apply it when it seems like a good idea to load the dice." it is striking.

If any branch of the federal government needs a thorough and public review of its operations, it is the Supreme Court.
