Elmer, why are there no class actions against jerry, when he admits to lies?

There were many lawsuits pending specifically for the "yields problems are behind us now, oops we still have yield problems even though I lied and told you we didn't" fiasco. Paul Engle knows how to access them but I don't.

Don't kid yourself. AMD has lawsuits lines up like airplanes circling a major airport waiting for their landing slot.

Still, if things were as bad as you say all the market signs of good things happening to AMD would not be there.

AMD is losing money in an environment where Intel can not meet market demand. What do you think will happen when Intel can meet demand? AMD will lose MORE money.

If things were bad for AMD it would be Intel parts being featured as the best of breed PCs in major magazines. It would be AMD whose prices wre sliding as they could not get people to buy their parts. What do we find?

We find a U.S. retail market almost devoid of AMD products.

AMD parts in demand, AMD featured in laptops as well as desktops as best of breed., and....AMD prices actually rising on the spot market.

AMD parts in demand? Maybe, but AMD products missing. Go into the retail outlets and most are almost all Intel.

You better hope Intel can't make many .13u Northwoods. A robust supply of higher performance P4 will force ASPs down for AMD. That means more and more red ink.

BTW, I spoke with an Intel engineer recently. The Tualatin yield on 12" wafers will be over 5x what I calculate AMD's per wafer yield of Athlons. And I'm being very conservative. >5x! AMD will be about 3 years behind Intel in moving to 12" and Northwood will certainly enjoy a major benefit as well. How does AMD compete with this?

Advanced Micro Devices denied allegations Friday within a class-action lawsuit filed last week that said the company artificially inflated its stock price over the past few quarters with overly optimistic projections for revenue from its K6 microprocessors. Even as the company rebutted the claims, a second, nearly identical suit has also been announced.
"The lawsuit filed on behalf of a shareholder is totally without merit," said Thomas McCoy, senior vice president and general counsel at AMD, adding the company intends to fight the charges.

Two separate suits were filed on behalf of shareholders last week, both in U.S. District Court for the Northern District of California, and both naming the company and its CEO, William J. (Jerry) Sanders. The first was announced early Wednesday morning, and was filed on behalf of shareholders who purchased AMD stock between Nov. 12, 1998, and Jan. 13 of this year. The second was announced Friday, covers the same period, and makes essentially the same complaint.

The suits say during that period, AMD publicly projected demand for its K6 microprocessors would swell, leading to increased revenue. While demand has indeed increased, AMD has been beset with manufacturing problems, which have limited its ability to deliver enough of the fastest K6-2 chips. As a result, unit volumes have not met expectations, and the chips that have been delivered have not included enough of the higher-profit features to generate the expected revenue.

Both suits say the company knew about the manufacturing problems -- or should have known -- but recklessly continued to project strong earnings potential. During the period covered by the suits, AMD's stock swelled to a high of 32, as analysts predicted the company would see strong revenue and market-share gains.

Instead, stock prices fell 20 percent within one day of announcing its fourth quarter earnings on Jan. 13, when the company revealed design and manufacturing problems had kept it from meeting earnings expectations.


Both suits seek unspecified damages. An AMD spokesman said the company had not yet reviewed the second case and said it would be imprudent to comment at this time.

Creditor, Shareholders Take Critical Look At AMD

Advanced Micro Devices' manufacturing difficulties and volatile stock price have prompted a possible downgrade of its credit rating and two class-action lawsuits.
Moody's Investors Service has placed AMD under review, evaluating its credit and secured debt in light of AMD's recent announcement that manufacturing difficulties would contribute to a significant shortfall for the current quarter. Moody's is reviewing all AMD's senior debt offerings, including its $400 million Senior secured public debt, $517 million unsecured public debt, $250 million bank loan, and secured and unsecured shelf registrations.

That debt will be used to fund AMD's ongoing capital-equipment investment, which will total about $900 million this year, according to Moody's.

AMD's cycle of optimistic production forecasts, followed by disclosures that it would fail to meet those estimates, also led a Southern California law firm to file suit against AMD. The suit claims AMD either deliberately or carelessly touted its manufacturing capabilities, causing Wall Street analysts to raise their estimates of the company's stock, which plunged when manufacturing problems were later disclosed.

The lawsuits filed on behalf of shareholders are totally without merit, said Thomas M. McCoy, senior vice president and general counsel of AMD, in a statement. "The company will vigorously contest the suit[s]."
