No, I am denying that it quacks, flies, and passes guano like a duck. I am saying that the matter is by no means that evident, and that one cannot confidently assert much without closer analysis. For one thing, if it were mainly a partisan reaction, I would expect a larger uptick. For another, even the chief justice of the Florida Supreme Court, a Democrat, deplored the Florida decision, and two non- conservative justices of the USSC agreed with the equity argument. To substantiate (1), you have to make a better case that my position is not quite reasonable. That would require addressing my specific arguments against the case (2)......
