The uncertainty over the outcome of the FCC appeal is exactly the sort of thing that makes investors wary, and as you note, makes NextWave a good speculation. Moreover, if NextWave keeps the spectrum, there is nothing to prevent NextWave from selling off some of those assets to raise cash to implement CDMA services elsewhere, nor is there anything to prevent another service provider from offering to buy the whole company.
