That may be a resonable position to take. But as a business, SI needs to balance the costs and benefits of that path with the costs and benefits of complying with the subpoena. Costs and benefits, of course, include more than money. If they believed there would be a significant outflow of members from complying with the subpoena, that would be a cost. If they believed that taking a stand here would benefit them in not having to deal with as many future subpoenas, that would be a benefit. But Infospace is not a charitable organization, so they need to make a rational business decision within the context of the law.
