CB, Greenspan has testified numerous times against the regulation of over the counter derivative instruments. His position has always been than market forces (i.e. counterparties) will self-enforce market risk by refusing to trade with those who employ unsafe levels of leverage. Of course counterparties are often not aware of overall firm risk (e.g. LTCM and Enron) until the ball unravels.
